Terms and Conditions
The Terms and Conditions below are set out in the contract which is provided to any couple wishing to book the services of Allan Law Photography (a trading name of Allan Law)
CONFIRMATION: A signed ‘CONTRACT FOR WEDDING PHOTOGRAPHY SERVICES’ and payment of the booking fee are necessary to confirm the stated wedding services from the photographer/s and to secure the date.
PRE-WEDDING CONSULTATION: The bride and groom will outline broadly what is required and the Photographer/s will advise on planning, logistics and timings where needed. A ‘Must Have Shot’ sheet shall be provided for preferred photographs that the photographer should try and include within the day’s proceedings. The photographer shall use his discretion and try to fulfil this request, but cannot be held liable should all/some of the requested photographs not be captured due to time restraints or non-cooperative guests. If a meeting in person is not possible, all consultation can be carried out via email or telephone. Records of the email ‘conversation’ shall be kept on file for a period of 1 year.
COOPERATION: The bride and groom and the photographer consent to happily communicate and cooperate with each other to achieve the best possible result within the understanding of this contract. The bride and groom or a nominated guest/bridal party member should make the photographer aware of key events at the wedding to give the photographer time to prepare for these e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests like having their photo taken, in such cases the photographer will use his discretion but cannot be held responsible for a possible lack of photographs of these people.
THE SCHEDULE: The photographers shooting style and experience are designed to achieve the best possible set of wedding photographs for the bride and groom, in cases where there is a possible delay in the proceedings, we shall endeavour to compensate for this to achieve the same result, but cannot guarantee to take out normal set of photographs.
WEDDING GUESTS: Whilst we actively encourage guests to photograph the day’s events and as many will have digital cameras with them, we do ask that the contracted photographer is given precedence to capture your day to the best of our ability. We cannot be held responsible for the lack of certain photographs if guests have continually interrupted the photographers work.
HOUSE RULES: The Photographers are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some venues insist on no flash photography, others insist that the photographer shoot from a specific location. In such circumstances the bride and groom accept the rules of the venue and the technical limitations placed on the photographer. If these rules or others are imposed, we advise the bride and groom to discuss this with the venue concerned and also make us aware.
COPYRIGHT LAW: Copyright Law states that the copyright of the photographs remains with the photographer, the photographer grants the bride and groom permission to make copies of the images under the following conditions: – The images taken by the photographer are for personal use by the bride and groom, their friends and relatives, Selling, Publication or any Commercial use of the photographs is not allowed without prior written permission from the photographer.
MODEL RELEASE: The bride and groom grant the photographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photographs for editorial, advertising and any other purpose without restriction. This may also include inclusion on social networking sites and the photographers own website.
PROVISIONAL BOOKINGS – Under the Consumer Protection (Distance Selling) Regulations 2000 (hereinafter referred to as “the Distance Selling Regulations”), you as a consumer are entitled to cancel your contract with Allan Law T/A Allan Law Photography within 14 days of agreeing its terms.
These Terms and Conditions will form the basis of any such contract. By making a provisional booking, you are deemed to have agreed to these Terms and Conditions and therefore to the terms of the contract between you and Allan Law T/A Allan Law Photography.
CONFIRMED BOOKINGS – In order to confirm your booking, payment of the deposit as detailed below is required. Accordingly, payment of the deposit by you will constitute your agreement for our service under the contract to commence, and such payment will therefore bring to an end your right to cancel under the Distance Selling Regulations, in terms of Regulation 13(1)(a).
If no deposit is received by the end of the 14 day period, the booking will automatically be released.
The booking fee is due on signing of this agreement and after the 14 day cooling off period has expired. If the booking is paid at the time of signing, the client still has the 14 day cooling off period and a full refund of the booking fee is refundable. If the booking is made with less than 14 days until the booked date, then subsequently cancelled, no refund shall be due.
The remaining balance of the agreed amount is payable ONE month before the date of the wedding (unless an arrangement has been made which differs from this e.g. payment has been made in full by mutual agreement).
In the event of cancellation outwith the aforementioned 14 day period, all booking fees/deposits are non-refundable. This includes circumstances where the bride and the groom cancel their wedding for whatever reason. This is at the discretion of the business.
If , (for whatever reason), the booking is cancelled after the 14 day cooling off period has expired then the following cancellation policy applies:
